Over 20 years of jail time handed down to French physician for repeated instances of medical abuse
West French City of Vannes Courts sectioned a retired surgeon to 20 years' imprisonment for sexually abusing 299 children, mostly minors, over a four-decade period. The trial, regarded as the most substantial in France involving child abuse, held the retired clinic doctor Joël Le Scouarnec (74) accountable for abusing 158 patients and 141 female patients, with the average age of 11 years.
The court agreed with the prosecution's request for the maximum sentence, with the presiding judge citing that the doctor had callously exploited the children's vulnerability without empathy. The judge further noted that the doctor had breached the trust of the patients' parents, and shattered their faith in the healthcare system. Despite the massive number of victims and the severity of the crimes, no additional sentence was feasible, the judge explained, as many of the victims wished to see the convict behind bars for life.
The surgeon confessed to abusing his victims during surgeries, while they were under anesthesia, and even in patient rooms, often disguising his actions as medical examinations.
Following the trial, questions have arisen regarding the delayed response of health authorities to stop Dr. Le Scouarnec, particularly given his earlier conviction for possessing child pornography in 2005. The defense referred to it as "a significant failure in our healthcare system," stating that indications of misconduct were overlooked, and the doctor was permitted to continue practicing.
Victims also criticized the tardiness of the authorities in responding to the doctor's crimes. "How could Dr. Scouarnec practice for 30 years without detection?", a 36-year-old victim said in court. The French Medical Association acknowledged its failings in the case.
Before sentencing, protesters formed a human chain outside the court, displaying placards bearing the names of victims as part of a demonstration. One sign read, "Who allowed this?" expressing the demand for accountability.
Law enforcement initiated the investigation in 2017 after a neighbor reported that her six-year-old daughter had been abused in the doctor's garden. During searches, investigators discovered around 300,000 child pornography images and diaries detailing the surgeon's years-long abuse. Given this evidence, investigators sought out the now-unaware victims that the surgeon had encountered during his tenure in rural clinics in western France.
As the trial unfolded, several victims spoke publicly about the trauma and psychological damage caused by the abuse. While still children, many did not perceive the violence they experienced, but unconsciously reacted to it.
Expert evaluators identified post-traumatic syndromes, blocks, and physical ailments in the victims, all resulting from psychological stress. Some symptoms emerged only after investigators approached the victims and informed them they were childhood victims of abuse.
At the advent of the trial, the retired surgeon admitted to the court his heinous acts. "I have committed hideous deeds," he acknowledged. "I must own up to my actions and face the repercussions for the victims, who will carry these burdens for the remainder of their lives." Surprisingly, the doctor later admitted to having abused his two-year-old granddaughter during the crime.
The doctor was sentenced to 15 years in prison in 2020 for abusing four children.
