England and Wales bid goodbye to the outdated Vagrancy Act of 1824, officially confirmed by the British government on Tuesday, with plans to abolish it by the spring of 2026. This 200-year-old piece of legislation, enacted during the Napoleonic Wars and the Industrial Revolution, criminalized rough sleeping on the streets—an antiquated rule that targeted the homeless and the jobless.
During that turbulent era, many men found themselves homeless and resorted to sleeping and begging on the streets to stay alive. The Industrial Revolution saw a surge of job-seekers from the countryside to cities, catapulting housing demands and resulting in a relegation of countless individuals to the street. Ever since, those caught napping (literally) on the streets faced hefty fines or even incarceration.
Recent statistics paint a vivid contrast. In 2023, the number of prosecutions and convictions under the 1824 law plummeted to 79 and 59, as compared to the staggering 1,050 prosecutions and 810 convictions in 2011.
Here Comes the Dawn: Abolishing Laws Against the Homeless
"We're disengaging from almost two centuries worth of injustice against the most vulnerable sections of our society, who deserve nothing less than dignity and assistance," noted British Deputy Prime Minister Angela Rayner. "It's unacceptable for individuals to be penalized merely because they've found themselves sleeping on the streets. With this law's repeal, we ensure that will never happen again."
The government's intention to scrap this archaic law was initially declared in 2022 by the preceding Conservative administration, which aimed to replace it with a novel piece of legislation. However, this plan failed to materialize before the 2022 parliamentary elections.
