Governments Introduce New Measures to Prohibit Smoking within Motor Vehicles

In recent news, the Bundesrat is contemplating a bill that could potentially ban smoking in cars when minors or pregnant women are present. This proposal, initially proposed by the then Federal Health Minister Karl Lauterbach in the summer of 2023, has been under discussion for several years.

The federal states of North Rhine-Westphalia (NRW) and Lower Saxony (Niedersachsen) were the most recent to submit this proposal to the Bundesrat. The draft states that minors and unborn children are more susceptible to the harmful effects of passive smoking in enclosed spaces, such as cars.

The bill, if approved by the Bundesrat, would be sent to the Bundestag for further consideration. However, it's important to note that a previous amendment for a smoking ban in cars did not pass due to a change of government in the last legislative period.

In March 2022, the Bundesrat decided to submit a bill to the Bundestag regarding the smoking ban in cars, highlighting the potential health risks associated with tobacco smoke pollution in closed passenger compartments. According to the draft, the pollution levels in such spaces can reach several times that of a heavily smoked pub within a few minutes of smoking a single cigarette.

As the debate continues, it remains to be seen whether the smoking ban in cars will become law. The health implications for children and pregnant women are a significant concern, and the discussion is expected to continue in the coming months.
