Airline ordered to pay compensation to firefighter.
In June 2022, a tragic incident occurred when a Mi-8MTV-1 helicopter carrying firefighting paratroopers performed a hard landing in a forest belt, 30 km from Chagda. The helicopter, maintained by AO Aviacompania Polar Airlines, fell with people on board at approximately 21:15. As a result, both crew members and passengers sustained injuries of varying severity, and the helicopter was destroyed.
The cause of the aviation incident was overloading of the aircraft. The plaintiff, a firefighting paratrooper, was airlifted to the Republican Hospital and diagnosed with aviation trauma, concussion, severe headache syndrome, and lower jaw fracture.
In December 2023, the criminal case related to this incident was closed due to the absence of a crime. However, the plaintiff filed a lawsuit seeking compensation for moral damages due to the injury.
The Yakutsk City Court ruled to recover 350,000 rubles from AO "Aviacompania Polar Airlines" as compensation for moral damages due to the injury. The defendant, AO "Polar Airlines", did not acknowledge the claim.
In response, AO "Aviacompania Polar Airlines" filed an appeal with the Supreme Court of the Sakha Republic (Yakutia) requesting to reduce the compensation amount to 150,000 rubles. However, the Supreme Court left the appeal without satisfaction, and the compensation amount for moral damages remains at 350,000 rubles as decided by the Yakutsk City Court.
The Supreme Court of the Sakha Republic (Yakutia) did not provide a reason for not reducing the compensation amount in its decision. The decision of the Yakutsk City Court regarding the compensation for moral damages entered into legal force. Additionally, the Yakutsk City Court also ordered AO "Aviacompania Polar Airlines" to pay 10,000 rubles for the costs of preparing the lawsuit.
